ยินดีต้อนรับสู่บ้านนักอ่าน by Dearbook (“บริการ”) ซึ่งเป็น พื้นที่บันทึกการอ่านสำหรับนักอ่าน — ให้ท่านบันทึกหนังสือที่อ่าน เขียนสิ่งที่ “ตกตะกอน” จากหนังสือด้วยคำพูดของท่านเอง เก็บเป็นไดอารี่และห้องสมุดส่วนตัว ติดตามนักอ่านท่านอื่น และเห็นพัฒนาการการอ่านของตนเอง บริหารและให้บริการโดย Dearbook

บ้านนักอ่าน ขายเครื่องมือของเราเอง บริการนี้ไม่ได้สร้างขึ้นบนการทำซ้ำ หรือขายเนื้อหาหนังสือของผู้อื่น (ดูรายละเอียดที่ นโยบายเนื้อหาและลิขสิทธิ์)

การเข้าใช้งานบริการนี้ ไม่ว่าจะในฐานะผู้เยี่ยมชม ผู้ใช้ฟรี หรือสมาชิกแบบเสียค่าใช้จ่าย ถือว่าท่านได้อ่าน เข้าใจ และยอมรับเงื่อนไขฉบับนี้ รวมถึงนโยบายเนื้อหาและลิขสิทธิ์ (Content & Copyright Policy) และนโยบายความเป็นส่วนตัว (Privacy Policy) แล้ว หากท่านไม่ยอมรับเงื่อนไขใด ๆ โปรดงดใช้งานบริการ

• ผู้ใช้ต้องมีอายุ อย่างน้อย 13 ปีบริบูรณ์ จึงจะสมัครบัญชีได้ หากท่านอายุต่ำกว่า 20 ปีบริบูรณ์ การสมัครและใช้งานต้องได้รับความยินยอมจากผู้ปกครองตามกฎหมาย
• ผู้ใช้ต้องให้ข้อมูล ที่ถูกต้องและเป็นปัจจุบัน ขณะสมัคร เช่น อีเมล และข้อมูลโปรไฟล์
• ผู้ใช้รับผิดชอบในการรักษาความปลอดภัยของบัญชี (อีเมลและการเข้าถึง) และยอมรับว่ากิจกรรมทั้งหมดที่เกิดขึ้นภายใต้บัญชีของท่านถือว่าท่านเป็นผู้กระทำ
• หนึ่งบุคคล สามารถสมัครบัญชีได้เพียง หนึ่งบัญชีหลัก ห้ามสร้างบัญชีปลอมหรือบัญชีสำหรับการละเมิด

บริการแบ่งเป็น 2 ระดับ ได้แก่ Free และ Pro รายละเอียดของแต่ละแพ็กเกจดูได้ที่หน้า /pricing

ขณะนี้ Pro ยังอยู่ระหว่างการพัฒนาและยังไม่เปิดให้สมัคร — บ้านนักอ่านยังไม่เรียกเก็บเงินจากผู้ใช้รายใด เงื่อนไขการชำระเงิน (รอบบิล การต่ออายุ ราคา และช่องทางชำระเงิน) จะประกาศให้ทราบเมื่อเปิดให้บริการ Pro และเราจะขอความยินยอมจากท่านอีกครั้งก่อนเริ่มเรียกเก็บเงินใด ๆ (ตามข้อ 09)

เมื่อเปิดให้บริการ ผู้ใช้ต้อง บรรลุนิติภาวะ (อายุ 20 ปีบริบูรณ์) จึงจะสมัคร Pro ซึ่งเป็นบริการแบบมีค่าใช้จ่ายได้ด้วยตนเอง หากอายุต่ำกว่านั้นต้องได้รับความยินยอมจากผู้ปกครองตามกฎหมายก่อน (สอดคล้องกับข้อ 02)

เนื่องจากยังไม่มีการเรียกเก็บเงิน จึงยังไม่มีค่าบริการที่ต้องคืนหรือยกเลิก เงื่อนไขการคืนเงินและการยกเลิกจะประกาศพร้อมกับการเปิดให้บริการ Pro ทั้งนี้ บันทึกการอ่านทั้งหมดของท่านเป็นของท่านเสมอ ไม่ว่าจะอยู่ในระดับบริการใด

ในกรณีที่บ้านนักอ่าน จะปิดให้บริการแบบถาวร เราจะประกาศให้ทราบล่วงหน้าบนเว็บไซต์และภายในแอปตามสมควร (โดยทั่วไปอย่างน้อย 30 วัน) เพื่อให้ท่านมีเวลาเก็บสำเนาข้อมูลของท่าน

ผู้ใช้ตกลงว่าจะไม่ใช้บริการเพื่อ:

• โพสต์หรืออัปโหลดเนื้อหาที่ละเมิดลิขสิทธิ์หรือสิทธิ์ ของบุคคลที่สาม เช่น คัดลอกข้อความจากหนังสือมาเป็นปริมาณมาก โดยไม่มีสิทธิ์ (ดูรายละเอียดที่ นโยบายเนื้อหาและลิขสิทธิ์)
• เผยแพร่เนื้อหาที่ผิดกฎหมายไทย ขัดต่อความสงบเรียบร้อยหรือศีลธรรมอันดี หมิ่นประมาท ลามกอนาจาร ยุยงให้เกิดความรุนแรง หรือเลือกปฏิบัติ
• พยายามเข้าถึงระบบโดยไม่ได้รับอนุญาต ทำ reverse engineering, เจาะระบบ, scraping จำนวนมาก หรือใช้บอตที่ละเมิดข้อจำกัด API
• ขายต่อ ให้เช่า หรือใช้บริการเชิงพาณิชย์ในนามของบุคคลที่สามโดยไม่ได้รับอนุญาต เป็นลายลักษณ์อักษร
• ปลอมตัวเป็นบุคคลอื่น หรือสร้างเนื้อหาที่ทำให้เข้าใจผิดเรื่องที่มา

การละเมิดข้อใดข้อหนึ่ง อาจส่งผลให้บัญชีของท่านถูกระงับหรือยุติทันที โดยไม่ต้องแจ้งล่วงหน้า และไม่มีการคืนเงินค่าสมาชิก

• ส่วนติดต่อผู้ใช้, โค้ด, การออกแบบ, แบรนด์บ้านนักอ่าน และ Dearbook, และเนื้อหาที่ทีมงานจัดทำ (เช่น Book Spotlight) เป็น ทรัพย์สินของ Dearbook และได้รับการคุ้มครองตามกฎหมายลิขสิทธิ์ เครื่องหมายการค้า และกฎหมายอื่นที่เกี่ยวข้อง
• เนื้อหาที่ผู้ใช้สร้างขึ้น — บันทึกการอ่าน ข้อความตกตะกอน ไดอารี่ รูปภาพ (ปกหนังสือ/รูปโปรไฟล์) บันทึกเสียง และข้อมูลโปรไฟล์ —ลิขสิทธิ์ยังคงเป็นของผู้ใช้ โดยการโพสต์ ผู้ใช้ให้สิทธิ์บ้านนักอ่าน ในการจัดเก็บ ย่อขนาดและแปลงรูปแบบภาพเพื่อการแสดงผล และเผยแพร่บนแพลตฟอร์มตามวัตถุประสงค์ของบริการเท่านั้น
• ข้อมูลหนังสือ (ชื่อเรื่อง ผู้เขียน สำนักพิมพ์ ปก) ใช้เพื่อระบุและอ้างอิงถึงหนังสือ ลิขสิทธิ์ยังคงเป็นของเจ้าของเดิม

• ผู้ใช้สามารถลบบัญชีของตนเองได้ตลอดเวลาผ่านหน้า /settings
• บ้านนักอ่านอาจระงับหรือยุติบัญชีหาก: พบการละเมิดเงื่อนไข, ได้รับ takedown notice ที่มีมูล, หรือมีเหตุอันสมควรเพื่อปกป้องผู้ใช้รายอื่นหรือบริการโดยรวม
• เมื่อบัญชีถูกยุติ เนื้อหาที่ผู้ใช้สร้างขึ้นและข้อมูลส่วนบุคคล จะถูกลบหรือทำให้ไม่สามารถระบุตัวตนได้ภายใน 30 วัน ยกเว้นในกรณีที่กฎหมายกำหนดให้เก็บรักษา

• บริการบ้านนักอ่าน ให้บริการตามสภาพ (“AS IS”) และตามที่มี (“AS AVAILABLE”) เราไม่รับประกันว่าบริการจะไม่มีข้อผิดพลาด ไม่หยุดชะงัก หรือเหมาะสมกับวัตถุประสงค์เฉพาะของผู้ใช้
• เราไม่รับประกัน uptime หรือความพร้อมใช้งานของบริการ ณ เวลาใดเวลาหนึ่ง แม้ว่าเราจะพยายามอย่างดีที่สุดในการให้บริการอย่างต่อเนื่อง
• ในกรณีที่กฎหมายอนุญาต ความรับผิดสูงสุดของบ้านนักอ่าน ต่อผู้ใช้แต่ละราย ไม่เกินจำนวนเงิน ที่ผู้ใช้ได้ชำระให้แก่บ้านนักอ่าน ในรอบ 12 เดือนที่ผ่านมา
• เราไม่รับผิดต่อความเสียหายทางอ้อม ความเสียหายต่อเนื่อง การสูญเสียกำไร หรือการสูญเสียโอกาสทางธุรกิจ
• เราสำรองข้อมูลตามสมควร แต่ไม่รับประกันว่าข้อมูลจะไม่สูญหาย ความรับผิดต่อการสูญหายของข้อมูล อยู่ภายใต้ขอบเขตข้างต้น ผู้ใช้ควรเก็บสำเนางานเขียนที่สำคัญของตนไว้ด้วย

บ้านนักอ่านอาจปรับปรุงเงื่อนไขนี้เป็นครั้งคราว ทุกฉบับระบุวันที่มีผลไว้ที่ด้านบน เมื่อมีการเปลี่ยนแปลงในสาระสำคัญ เราจะประกาศบนเว็บไซต์ล่วงหน้าตามสมควร และ ระบบจะขอให้ท่านอ่านและยอมรับเงื่อนไขฉบับใหม่ก่อนใช้งานต่อ การแก้ไขถ้อยคำ หรือการเปลี่ยนแปลงที่กฎหมายกำหนด อาจมีผลทันที

เงื่อนไขฉบับนี้อยู่ภายใต้ กฎหมายไทย ในกรณีที่เกิดข้อพิพาท คู่สัญญาตกลงที่จะ พยายามเจรจากันก่อนเป็นอันดับแรก หากการเจรจาไม่สำเร็จ ให้ ศาลที่กรุงเทพมหานคร เป็นศาลที่มีเขตอำนาจในการพิจารณาคดี

Welcome to Baannakarn by Dearbook (the “Service”) — a reading journal for readers where you log the books you read, write what each book leaves behind in you — your reflections — in your own words, keep a private diary and library, follow other readers, and watch your own reading grow. Operated by Dearbook.

Baannakarn sells its own tools — the Service is not built on reproducing or selling other people's book content (see our Content & Copyright Policy).

By accessing the Service — whether as a visitor, free user, or paid subscriber — you confirm that you have read, understood, and accepted these Terms, together with our Content & Copyright Policy and Privacy Policy. If you do not accept any part of these Terms, please refrain from using the Service.

• You must be at least 13 years old to create an account. If you are under 20 years of age (Thai majority age), registration and use require parental or legal-guardian consent.
• You agree to provide accurate, current information when registering (email, profile details).
• You are responsible for maintaining the security of your account (email access, credentials). All activity occurring under your account is deemed performed by you.
• Each person may hold one primary account. Fake or abusive accounts are prohibited.

The Service is offered in two tiers — Free and Pro. Details of each plan are available at /pricing.

Pro is still in development and not open for subscription — we charge no one today. Payment terms (billing period, renewal, prices, and payment methods) will be published when Pro launches, and we will ask for your consent again before any charge is made (see Section 09).

Once open, you must have reached the age of majority (20 years in Thailand) to subscribe to Pro — a paid service — on your own; otherwise, parental or legal-guardian consent is required (consistent with Section 02).

As nothing is charged yet, there is no fee to refund or subscription to cancel. Refund and cancellation terms will be published together with the Pro launch. Your reading records are always yours, whichever tier you are on.

If Baannakarn will permanently discontinue the Service, we will give reasonable advance notice on the website and inside the app (normally at least 30 days) so that you have time to keep a copy of your data.

You agree not to use the Service to:

• Post or upload content that infringes third-party copyright or rights — for example, copying substantial passages from a book without the right to do so (see Content & Copyright Policy).
• Distribute content that violates Thai law, public order, or morals; defamatory, obscene, inciting violence, or discriminatory content is prohibited.
• Attempt unauthorised access, reverse-engineer the platform, perform mass scraping, or use bots that violate API limits.
• Resell, sublicense, or commercially exploit the Service on behalf of third parties without our written permission.
• Impersonate others or create content that misrepresents its source.

Violations may result in immediate suspension or termination of your account without prior notice and without refund.

• The user interface, code, design, Baannakarn and Dearbook brand identities, and content we produce (such as Book Spotlight) are the property of Dearbook, protected under copyright, trademark, and other applicable laws.
• User-generated content — reading logs, reflections, diary entries, images (book covers / profile pictures), voice notes, and profile data — remains your copyright. By posting it, you grant Baannakarn a licence to host, store, resize and reformat images for display, and display such content on the platform solely as needed to operate the Service.
• Book information (title, author, publisher, cover) is used to identify and reference books; the underlying rights remain with their owners.

• You may delete your account at any time via /settings.
• Baannakarn may suspend or terminate accounts for: violations of these Terms, valid takedown requests, or reasonable cause to protect other users or the Service.
• Upon termination, user-generated content and personal data will be deleted or anonymised within 30 days, except where retention is required by law.

• The Service is provided “AS IS” and “AS AVAILABLE”. We do not warrant that the Service will be error-free, uninterrupted, or fit for a particular user's purpose.
• We do not guarantee uptime or availability, although we make reasonable efforts to maintain continuous service.
• To the extent permitted by law, Baannakarn's aggregate liability to any user shall not exceed the amount paid by that user to Baannakarn in the preceding 12 months.
• We are not liable for indirect, consequential, lost-profit, or business-opportunity damages.
• We keep reasonable backups but do not guarantee against loss of data; liability for data loss is subject to the limit above. You should keep your own copy of writing that matters to you.

Baannakarn may update these Terms from time to time; every version carries its effective date at the top. For material changes we will post notice on the website in reasonable advance, and the app will ask you to read and accept the new version before you continue. Wording fixes and changes required by law may take effect immediately.

These Terms are governed by the laws of Thailand. In the event of a dispute, the parties shall first attempt good-faith negotiation. Failing that, the courts of Bangkok, Thailand shall have exclusive jurisdiction.
